TMSFly acts as an online travel intermediary and facilitates bookings on behalf of third-party suppliers. TMSFly does not own, operate, or control airlines, hotels, transportation services, or travel products unless explicitly stated.

All bookings are subject to:

• Supplier rules and restrictions

• Availability at the time of confirmation

• Fare rules, change policies, and cancellation conditions

3. User Eligibility

By using TMSFly, you confirm that:

• You are 16 years of age or older

• You have the legal capacity to enter into binding contracts

• All information provided by you is true, accurate, and complete

4. Booking & Payment Terms

• Prices displayed are subject to availability and may change until booking confirmation.

• Full payment is required to confirm bookings unless stated otherwise.

• Payments once made are non-refundable, except as per applicable supplier policies.

• TMSFly reserves the right to cancel or suspend bookings due to:

  • Payment failure

  • Suspected fraud or misuse

  • Technical, pricing, or supplier-related errors

5. Flight Bookings

• Flight fares are governed by airline fare rules and conditions.

• Name changes, date changes, cancellations, and refunds are subject to airline penalties.

• TMSFly is not responsible for:

  • Flight delays, cancellations, or schedule changes

  • Denied boarding

  • Baggage loss or damage

  • Visa rejection or immigration issues

6. Hotel & Accommodation

• Hotel descriptions, images, ratings, and information are provided by suppliers.

• Check-in and check-out times are governed by hotel policies.

• No-show or early check-out may result in 100% cancellation charges.

7. Holiday Packages & Activities

• Package inclusions and exclusions are clearly mentioned at the time of booking.

• Any unused services are non-refundable.

• Itineraries may be modified due to weather, operational issues, safety concerns, or force majeure events.

8. Cancellation, Refund & Amendment Policy

• Cancellation and refund policies vary by supplier.

• TMSFly service or convenience fees are non-refundable.

• Refund timelines depend on airlines, hotels, banks, and payment gateways.

• Partial refunds may apply after applicable deductions.

9. Visa & Travel Documents

• Visa assistance, if provided, does not guarantee visa approval.

• The traveler is solely responsible for:

  • Holding a valid passport

  • Obtaining visas, transit visas, and health certificates

  • Complying with immigration and local laws

TMSFly shall not be liable for visa rejection, denial of entry, or deportation.

10. User Responsibilities

You agree:

• Not to misuse the website or services

• Not to engage in fraudulent, illegal, or prohibited activities

• To verify all booking details immediately upon receiving confirmation

11. Intellectual Property

All content on TMSFly, including logos, trademarks, branding, text, images, software, and design elements, is the exclusive property of TMSFly and may not be copied, reproduced, or used without prior written permission.

12. Limitation of Liability

TMSFly shall not be liable for:

• Supplier failures or service deficiencies

• Indirect, incidental, or consequential damages

• Acts of God, force majeure events, or government actions

Any liability, if established, shall be limited strictly to the service fee charged by TMSFly for the specific booking.

13. Privacy & Data Protection

User data is collected and processed in accordance with our Privacy Policy and applicable data protection laws in India, UAE, and USA. By using TMSFly, you consent to the collection, use, and storage of your information for service delivery and communication purposes.

14. Modifications

TMSFly reserves the right to update or modify these Terms & Conditions at any time without prior notice. Continued use of the website or services constitutes acceptance of the revised terms.

16. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws applicable in the jurisdiction of the booking entity:

• India: Laws of India

• UAE: Laws of the United Arab Emirates

• USA: Laws of the State in which the TMSFly entity is registered

Courts of the respective jurisdiction shall have exclusive authority over disputes arising from bookings made under that entity.
